When you left home to get to work, the driving conditions were less than ideal, as it was pouring. Because you wanted to stay safe, you focused on the road ahead of you. Between the windshield wipers, the rain, and the other traffic in front of you, driving was stressful and dangerous.
You were staring so intently at the road ahead, you essentially developed tunnel vision, until a police car cut you off and you had to stop. You then saw another police car behind you. When the officers exited their vehicles, you were told a police car had been following you for a few miles with its lights on, and you failed to pull over. They said you were attempting to elude the police.
What Is Eluding and What Will You Face?
Virginia law states that eluding the police involves a person continuing to drive in a willful and wanton manner after he receives a visible or audible signal from any law enforcement officer to stop. If you are found guilty of this charge, you can receive:
- A misdemeanor or felony. Eluding the police is considered a Class Two Misdemeanor. This charge can elevate to a Class Six Felony if the operation of your vehicle put a police officer or other person in danger, including yourself. You can receive a Class Four Felony if eluding the police led to the death of an officer.
- License suspension. A driver convicted of an eluding offense can have his license suspended for anywhere from 30 days to one year. If a driver is convicted and was found to be driving 20 mph or more above the speed limit, the license is suspended for a minimum of 90 days. If convicted under a felony charge, the driver could face jail time.
