PENALTIES FOR MISDEANOR OR FELONY CONVICTIONS IN VIRGINIA

The various criminal offenses in Virginia are classified differently and often carry significantly different penalties. 

Misdemeanor Offenses in Virginia

Misdemeanor offenses are considered to be “lesser” offenses in the criminal justice system.  But, this does not mean that a misdemeanor conviction will result in a mere slap on the wrist.  Depending on the class of misdemeanor, you could face a substantial fine and extended incarceration.

Examples of some common misdemeanors in Virginia include Assault & Battery, DUI/DWI, Petit Larceny, Possession of Marijuana, Public Intoxication and Reckless Driving.

Misdemeanor classifications in Virginia are as follows:

• Class 1 misdemeanor – Confinement in jail for up to 12 months and a fine up to $2,500, either or both.

• Class 2 misdemeanor – Confinement in jail for up to 6 months and a fine up to $1,000, either or both.

• Class 3 misdemeanor – A fine up to $500.

• Class 4 misdemeanor – A fine up to $250.

Felony Offenses in Virginia

Felony offenses are the most serious offenses in the criminal justice system.  A felony conviction can affect many aspects of your life forever.  Aside from lengthy incarceration, a felony conviction can impact your credit, housing, education, ability to find employment, right to vote, etc.

Examples of some common felonies in Virginia include Arson, Burglary, Embezzlement, Grand Larceny, Possession of Controlled Substances (e.g., Cocaine, Heroin, etc.) and Murder.

Felony classifications in Virginia are as follows:

• Class 1 felony – Death or imprisonment for life and a fine up to $100,000.

• Class 2 felony – 20 years imprisonment to life and a fine up to $100,000.

• Class 3 felony – Five to 20 imprisonment and a fine up to $100,000.

• Class 4 felony – Two to 10 years imprisonment and a fine up to $100,000.

• Class 5 felony – One to 10 years imprisonment; or confinement in jail for up to 12 months and a fine up to $2,500, either or both.

• Class 6 felony – One to five years imprisonment; or confinement in jail for up to 12 months and a fine up to $2,500, either or both.
